Acceptance of terms

By downloading, installing, or using the FitHamAI mobile app or visiting fitham.ai, you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Mateusz Kaczmarczyk ("we", "us", "our") — a private individual based in Poland who operates FitHamAI.

If you do not agree with any part of these Terms, you must not use the service. These Terms apply together with our Privacy Policy, which is incorporated by reference.

What FitHamAI does

FitHamAI is an AI-powered calorie counting and nutrition tracking app. Core features include:

• AI meal photo scanning that estimates calories, macros, and nutrients.
• Barcode, fridge, receipt, and ingredient-label scanning.
• Personalized meal plans, shopping lists, and an AI voice coach.
• Daily nutrition tracking, charts, and progress reports.

The app is currently available on Android via Google Play. Most features require an internet connection because AI analysis runs on our backend.

We may add, modify, or discontinue features at any time. We will give reasonable notice of material changes that affect paid subscribers.

Creating and using your account

• Sign-in: most features require signing in with Google Sign-In. You may also try the app without an account with limited functionality.
• One account per user: you may not create multiple accounts or share an account with others.
• Age requirement: you must be at least 16 years old to use FitHamAI.
• Account security: you are responsible for keeping your Google account credentials secure. Notify us immediately if you suspect unauthorized access to your FitHamAI account.
• Accurate information: the information you provide (name, goals, preferences) must be accurate and up to date.

Free, PRO, and PRO+

FitHamAI offers the following subscription tiers:

• Free: limited daily scans and access to basic features at no cost, with ads.
• PRO (€4.99/month or equivalent): expanded scan limits, unlimited AI voice coach, fridge and receipt scanners, personalized meal plans, and no ads.
• PRO+ (€9.99/month or equivalent): everything in PRO plus restaurant menu scanner, advanced analytics, unlimited ingredient scanning, PDF and CSV export.
• Free trial: eligible new users can start a 7-day free PRO trial, offered once per account. Your subscription starts automatically when the trial ends unless cancelled.

Billing: all paid subscriptions are processed by Google Play Billing. You agree to Google Play's payment terms in addition to these Terms.

Auto-renewal: subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal. Renewal charges are taken by Google Play using your configured payment method.

Price changes: we may update subscription prices. We will notify you in advance and give you the option to cancel before any increase takes effect.

How to cancel and what gets refunded

• Cancel anytime: open Google Play Store → Profile → Payments & subscriptions → Subscriptions → FitHamAI → Cancel subscription.
• Continued access: after cancelling, you keep PRO or PRO+ features until the end of the current billing period. No further charges will be made.
• Refunds: refund eligibility is governed by Google Play's refund policy. Request refunds through Google Play Help.
• Trial: cancel during the 7-day trial to avoid being charged. If you do not cancel, your subscription begins automatically at the end of the trial.

Invite friends, earn PRO days

• Rewards: when a friend joins with your unique referral code, you receive 14 days of PRO and your friend receives 7 days of PRO.
• Monthly limit: up to 5 successful referrals per calendar month per user.
• Eligibility: the referee must be a new FitHamAI account and must enter the referral code at sign-up. You cannot use your own code.
• No cash value: referral rewards have no monetary value, cannot be exchanged for cash, and cannot be transferred to another account.
• Abuse: we reserve the right to revoke rewards and close accounts that abuse the program (for example, by creating fake accounts or using automated tools).

What you agree not to do

When using FitHamAI, you agree that you will not:

• Abuse, overload, or attempt to disrupt the service or our servers.
• Reverse engineer, decompile, or attempt to extract source code from the app, except as permitted by applicable law.
• Scrape, crawl, or use automated tools to access the service without our written permission.
• Upload photos or content that is illegal, harmful, harassing, or infringes on anyone's rights.
• Share your account credentials or let anyone else use your account.
• Impersonate another person or misrepresent your affiliation with anyone.
• Use the service to build a competing product or dataset.

The AI is a tool, not a doctor

FitHamAI uses artificial intelligence to estimate nutritional information from photos. These estimates are approximations — actual values may vary based on portion size, ingredients, preparation method, lighting, and photo angle.

FitHamAI is not medical or nutritional advice. The information provided through the app is for general informational purposes only and is not a substitute for professional medical, dietary, or health advice.

Who owns what

• Our content: the FitHamAI app, website, branding, design, code, and all non-user content are owned by Mateusz Kaczmarczyk and protected by copyright, trademark, and other intellectual property laws.
• Your content: you retain all rights to the photos and data you upload. By using the service, you grant us a limited, non-exclusive, royalty-free license to process your content solely to provide the service to you (for example, sending a photo to the AI to identify your meal).
• Feedback: if you send us suggestions or feedback, you grant us the right to use them freely to improve the service, without obligation to you.

Service provided "as is"

FitHamAI is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, secure, or free of harmful components. We are not responsible for any inaccuracy in AI-generated nutritional data.

Maximum liability: to the extent permitted by law, our total liability to you for any claim arising out of these Terms or the service is limited to the amount of subscription fees you have paid us in the twelve (12) months preceding the claim, or €100, whichever is greater. We are not liable for indirect, consequential, incidental, special, or punitive damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those cases, the limitations above apply only to the extent permitted by law, and your statutory consumer rights remain unaffected.

How an account can end

• By you: you may delete your account at any time from Profile → Delete account, or by emailing privacy@fitham.ai. Deletion removes your personal data in accordance with our Privacy Policy.
• By us: we may suspend or terminate your account if you breach these Terms, abuse the service, engage in fraud, or if required by law. Where possible, we will give you prior notice and an opportunity to address the issue.
• Effect of termination: access to paid features ends at the close of the current billing period (or immediately in cases of serious breach). Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) will remain in effect.

Which law applies

These Terms are governed by the laws of Poland, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be resolved in the competent courts of Poland.

If you are a consumer residing in the European Union, nothing in these Terms affects the mandatory consumer protection rights granted to you under the laws of your country of residence. You may also have the right to bring proceedings in the courts of your country of residence.

How updates work

We may update these Terms from time to time. When we make material changes, we will:

• Notify you in the app or by email at least 30 days before the change takes effect.
• Update the "Last updated" date at the top of this page.
• Make the previous version available on request.

Continued use of the service after a change takes effect constitutes acceptance of the revised Terms. If you disagree with the changes, you can cancel your subscription and delete your account before the effective date.
